Application of these Terms & Conditions
- This document contains the terms and conditions ("Terms and Conditions") governing your use of this Website (www.nipponpaint.com.my) and your subscription to the Nippon Paint Colour Scheme Services provided by Nippon Paint Malaysia ("Nippon Paint").
- You must read, agree with and accept all of the Terms and Conditions contained herein which include those terms and conditions expressly set out below and those incorporated by reference.
- These Terms and Conditions shall be construed in accordance with and shall be governed by the laws in force in Malaysia. You irrevocably submit to and accept the exclusive jurisdiction of any of the Courts of Malaysia.
Subscription of Services (website only)
- The Nippon Paint Colour Scheme Services are available only to, and may only be used by individuals who can form legally binding contracts under the law. Without limiting the foregoing, our services are not available to children (persons under the age of 18).
- Registration and joining as a member is subject to a minimum purchase of at least 1 package under the Nippon Paint Colour Scheme Services. You will be given a User ID which shall not be transferred or sold to another party. You may be asked to provide personal information (including credit card information) to Nippon Paint when registering as a member.
- You are solely responsible for your personal information save that Nippon Paint will use and protect your personal information in accordance with Nippon Paint privacy policy (see below). You acknowledge that no data transmission over the internet can be completely secure, and Nippon Paint cannot give an absolute assurance that your personal information you provide to us will be secure at all times.
- You acknowledge that if you do not register as a member of this Website, your activity in this Website will be limited. Employees of Nippon Paint and its related corporate bodies are entitled to become members of the Website, but are not entitled to participate competitions (if any) organised by Nippon Paint on the Website.
- Without limiting other remedies, Nippon Paint may at its sole discretion limit your activity, temporarily or indefinitely suspend or terminate your membership and refuse to provide services to you if: (a) you breach any Terms and Conditions hereof or any terms incorporated by reference; (b) we are unable to verify or authenticate any information provided to us which we deemed is requisite and necessary; or (c) we believe that your actions may cause financial loss or legal liability to us.
- Nippon Paint may at its sole discretion change some or all of its services at any time. In the event Nippon Paint introduces a new service, it shall be effective on the date expressly stated as the effective launch date of the service.
Terms of Sale
- Any person who is above 18 years of age and owns a valid VISA or MASTERCARD Credit Card is allowed to transact on the Website.
- All transactions carried out are strictly non-refundable and are not available for exchange. Nippon Paint will provide telephone consultation should the colour schemes you purchased not meet your satisfaction. However, Nippon Paint will not resubmit new colour schemes to replace those that are already done. You must report to Nippon Paint any dissatisfaction within 30 days of receiving your colour schemes.
- All purchases are transacted in Ringgit Malaysia (RM).
- You represent and warrant that (a) any credit information you supply is true and complete; (b) charges incurred by you will be honoured by your credit card company; and (c) you will pay the charges incurred by you at the posted prices, including any applicable taxes.
Intellectual Property Rights
- Any person who is above 18 years of age and owns a valid VISA or MASTERCARD Credit Card is allowed to transact on the Website.
- You acknowledge and agree that the copyright and other intellectual property rights in this Website all information and materials on this Website are owned by Nippon Paint, its affiliates, suppliers or licensors unless otherwise expressly indicated. The Website content is protected by Malaysian and international copyright and trademark laws.
